Terms and conditions for participation in the raffle of Social Media:

This competition is not affiliated with Facebook or Instagram and is in no way sponsored, supported or organized by Facebook or Instagram. Instagram and Facebook are only the platform on which the raffle is posted. The recipient of the information provided by the participant is not Facebook but BMW AG. The information provided will only be used for the raffle for the two voucher for the restaurant BAvarie by Käfer (voucher value 50 € each). All questions, comments and/ or complaints regarding the raffle should be addressed exclusively to the BMW AG.
Participants do not assert any claims against Facebook or Instagram in connection with participation in the raffle. The participants exempt Facebook and Instagram from the claims of third parties arising from participation in the competition.
Eligibility, eligibility requirements
Only natural persons of full age and full legal capacity who have their place of residence and habitual residence in Germany and who have declared their agreement to these terms and conditions of participation are eligible to participate.
Participation in the raffle is by commenting on the Social Media post on Facebook or Instagram. In doing so, participants express that they have read the terms and conditions of participation and that they agree with them.
The closing date for entries in the competition is December 8th, 2022, 04.00 pm. Only those who participate within the time limit set for this will be admitted to the competition.
Participation itself is free of charge and independent of the purchase of goods or services. Multiple participation is not allowed. The participants are responsible for the accuracy of the data they provide.
Exclusion from participation
Persons who have not yet reached the age of 18 when participating are excluded from participation. BMW AG reserves the right to verify the age of majority. Participants who do not provide complete or truthful information about themselves may be excluded from participation. Participants who violate the terms and conditions of participation may be excluded. Participants are also excluded who want to gain advantages in implementation through unfair means or otherwise through manipulation and thus violate the principle of equal opportunities.
Employees of the BMW AG, subsidiaries and affiliated companies of BMW AG, including relatives, and employees of companies participating in the competition and their relatives are excluded from participation in the competition (§§ 15ff. AktG). The exclusion can also be carried out retrospectively and a profit can be reclaimed in this case.
Only those who participate within the time limit set for this will be admitted to the competition.
Conduct of the raffle, notification of the prize
Participation in the raffle is by commenting on the Social Media post. In doing so, participants express that they have read the terms and conditions of participation and that they agree with them.
The winner will be drawn at random no later than two days after the closing date for entries. The winner will be notified by BMW AG or the contracted partner in writing, by direct message via Instagram and Facebook (“Notification of the Prize”), whereby the claim to the prize only arises if the winner declares acceptance of the prize to BMW AG within 24 hours of sending the notification of the prize (” acceptance of profit”). If there is no declaration of acceptance by the winner within this period, a new winner will be drawn.

It is not possible to pay out the winnings in cash. Prizes are not transferable to other persons and cannot be exchanged.
Depending on availability, BMW AG reserves the right to provide at least equivalent performance as a profit instead of the stated one. If the profit information relates to an event with a fixed date or period, the prize will be forfeited without replacement in the event of cancellation.
In the case of event winnings, the prize will also be forfeited without replacement, insofar as the execution determined in consultation with the winner is later cancelled by the winner. This also applies in particular to cancellations due to personal illness or measures to contain the COVID-19 pandemic. Cash payment, exchange or transfer of the prize to third parties is not possible. Travel costs, food costs and costs for the underground car park are not covered. Legal recourse is excluded.
Premature termination and modification of the raffle
BMW AG reserves the right to terminate or amend the raffle at any time without prior notice if, for technical or other reasons, it cannot be guaranteed that the game will run properly or if the fairness of the game appears to be impaired. There are no claims for participants as a result.
The participants agree that their own name will be published in the context of the competition if they win.
Liability of BMW AG
BMW AG is only liable for damage in the event of intent and gross negligence. This does not apply in the event of injury to life, body or health. This also does not apply to breaches of essential contractual obligations. These are obligations that are essential for the execution of the raffle, as they make this possible in the first place and the participant therefore trusts and can rely on the fulfillment of these obligations. Compensation for the breach of essential contractual obligations is limited to foreseeable damage typical for competitions, unless there is intent or gross negligence or liability for injury to life, body or health.
In the event of a violation of the rights and guarantees of legality given by the participant, the participant exempts BMW AG from all claims asserted by third parties against BMW AG. In addition, the participant undertakes to support BMW AG in all respects in legal defense in the event of a legal dispute and to bear the costs of the necessary legal defense, including all court and legal fees. Any further claims for damages by BMW AG against participants remain unaffected.
Release of BMW AG from liability with regard to claims by third parties
If the participant violates the aforementioned conditions of participation, the participant, BMW AG, companies associated with BMW AG, as well as the employees, employees, representatives, shareholders and vicarious agents of BMW AG and/or companies associated with BMW AG in indemnify and hold harmless, upon first request, claims or claims of any kind which are raised by third parties on the basis of or in connection with content that the participant has provided and/or transmitted in the context of his or her participation in the competition. This also includes reasonable legal and court fees in each case.
Legal recourse is excluded. There is no legal claim to the profit or payment of the cash value. These terms and conditions of participation and the entire legal relationship between the participant and the BMW AG are exclusively subject to German law. German law applies to this raffle.

Personal data is collected by BMW AG for the execution of the raffle. In particular, this includes salutation, title, first and last name, date of birth, postal address, telephone number, e-mail address. The data is processed exclusively for the implementation of the competition (Art. 6 para. 1 lit. b) GDPR). In this context, these may be made available to third parties for the purpose of processing the competition (e.g. companies affiliated with the organizer within the meaning of Sections 15 et seq. of the German Stock Corporation Act and/or service providers) and deleted again after the competition has ended.
